1. Scope and Contracting Parties

These Terms & Conditions (“Terms”) apply to all purchases, orders, and contractual agreements concluded via this website (“Online Shop”).

The purchase contract is formed between:

and the customer (“you”, “your”).

By placing an order, you confirm that you have read, understood, and accepted these Terms.

2. Eligibility to Purchase

By placing an order through this website, you confirm that:

  • You are at least 18 years old, or

  • You have parental/guardian consent to make the purchase.

We reserve the right to refuse or cancel orders that do not meet these criteria.

3. Product Information and Availability

3.1 Accuracy of Descriptions

We make every effort to ensure that product descriptions, technical specifications, and images displayed on our website are accurate.
However, minor deviations may occur due to:

  • Manufacturer updates

  • Component availability

  • Display differences across devices

Such deviations do not constitute a defect.

3.2 Availability

All products are subject to availability.
In case an item becomes unavailable after an order has been placed, we will notify you promptly and provide:

  • A replacement option,

  • A new delivery date, or

  • A full refund.

4. Pricing and Payment

4.1 Prices

All prices listed on this website are in EUR (€) and include applicable taxes unless otherwise stated.

4.2 Payment Methods

We currently accept:

  • PayPal

  • Credit/debit cards

  • Bank transfer (prepayment)

  • Additional methods where listed

Payment must be completed in full before order processing begins.

4.3 Errors in Pricing

In the event of an obvious pricing error:

  • We reserve the right to cancel the order, and

  • Issue a full refund.

5. Order Process and Contract Formation

5.1 Order Placement

By adding products to your cart and completing the checkout process, you submit a binding offer to purchase.

5.2 Order Confirmation

A confirmation email is automatically generated.
This email acknowledges receipt of the order but does not constitute acceptance.

5.3 Order Acceptance

The contract is deemed concluded once:

  • We send a formal order acceptance,
    or

  • The goods are shipped.

We may decline an order for reasons such as:

  • Suspicion of fraud

  • Incorrect information provided

  • Unavailability of components

  • Abusive customer behaviour

6. Custom-Built PCs

6.1 Nature of Custom Products

Custom PCs are built according to individual specifications and component choices selected by the customer.

6.2 Exclusion from Withdrawal

Under EU law (Directive 2011/83/EU), customized products made to customer specifications are excluded from the right of withdrawal.

Therefore:

✔ Custom-built PCs cannot be returned or refunded,
except in cases of:

  • Manufacturing defects,

  • Damaged components on arrival,

  • Warranty claims.

6.3 Assembly and Testing

All custom PCs are assembled and tested before shipping.
Testing may include:

  • Stress testing

  • Performance benchmarking

  • Thermal validation

  • Firmware updates

Minor differences in benchmark scores, fan noise, or component tolerances do not constitute defects.

7. Shipping and Delivery

7.1 Shipping Providers

Deliveries are handled by:

  • DHL

  • DPD

  • UPS

7.2 Delivery Times

Estimated delivery times are provided on the Shipping & Payment Information page and during checkout.

7.3 Risk of Loss

Risk (ownership) transfers to the customer once the goods are handed over to the carrier, in accordance with § 447 BGB.

7.4 Delivery Delays

Delays may occur due to:

  • Supplier shortages

  • Logistic disruptions

  • Customs (for non-EU deliveries)

We are not liable for delays outside our control.

8. Warranty (Legal Guarantee)

8.1 Statutory Warranty

Consumers within the EU are entitled to a 2-year statutory warranty under Directive (EU) 2019/771.

This covers:

  • Manufacturing defects

  • Component failures

8.2 Warranty Exclusions

Warranty does NOT cover:

  • Damage caused by improper use

  • Unauthorized modifications

  • Overclocking damage

  • Liquid damage

  • Physical damage due to mishandling

  • Issues caused by third-party software

8.3 Warranty Procedure

To submit a warranty claim:

  1. Contact us at kontakt@kruos.de

  2. Provide order number and proof of issue

  3. We may request photos or diagnostic information

If the product must be returned, the customer may bear the shipping cost unless otherwise required by law.

9. Liability

We are liable only for:

  • Intentional misconduct,

  • Gross negligence,

  • Injury to life, body, or health,

  • Breach of essential contractual obligations.

We are not liable for:

  • Lost profits

  • Business interruption

  • Data loss

  • Indirect or consequential damages

unless legally required.

10. Retention of Title

Until full payment has been received, all delivered goods remain our property (Eigentumsvorbehalt).

11. Prohibited Use

You agree not to:

  • misuse the website,

  • engage in unlawful activity,

  • attempt to gain unauthorized access to systems,

  • interfere with business operations or online services.

Any violation may result in contract termination or legal action.

12. Force Majeure

We are not liable for failure to perform obligations due to events beyond our control, including:

  • Natural disasters

  • Acts of war

  • Government actions

  • Power or internet outages

  • Supplier failures

13. Governing Law and Jurisdiction

These Terms are governed by the laws of:

Germany.

If legally permissible, jurisdiction shall be the courts of:

Karlsruhe.

14. Amendments to These Terms

We may update or modify these Terms at any time.
The version in effect at the time of order placement applies to the contract.

Revised Terms will be published on this page with immediate effect.
